Please read these terms of service ("Terms", "Terms of Service") carefully before using the Depo-Sum website and service (the "Service") operated by Depo-Sum ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

We may, in our sole discretion, permit you from time to time to submit, upload, publish or otherwise make available to us content ("Your Content"). As between us and you, you own Your Content.

Subject to these Terms, you grant us a worldwide, non-exclusive, royalty-free, perpetual, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform Your Content solely for the purpose of providing the Service to you.

You warrant that you have all rights, power, and authority necessary to grant us the rights described above in Your Content.

Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

  • In any way that violates any applicable national, federal, state, local or international law or regulation
  • For the purpose of exploiting, harming or attempting to exploit or harm minors in any way

  • To impersonate or attempt to impersonate Depo-Sum, an employee of Depo-Sum, another user or any other person or entity
  • In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or otherwise objectionable
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm or offend Depo-Sum or users of the Service or expose them to liability

AI Processing and Transcript Data

Our Service uses artificial intelligence to process deposition transcripts. By using our Service, you acknowledge and agree:

  • You retain all rights to your transcript data and any underlying information
  • We use AI to generate summaries of your transcripts and provide that functionality as a service
  • We will not share your transcript data with third parties without your consent except as required by law
  • You are responsible for ensuring that your transcript data does not violate the rights of any third party
  • The AI-generated summaries are provided as a tool to assist in your legal work but are not a substitute for your professional legal judgment

Accuracy of Materials

The transcript summaries and other materials obtained through our Service are provided for informational purposes only. Depo-Sum makes no representations about the accuracy, reliability or completeness of any information, content, materials, products or services provided through our Service.

The transcript summaries generated by our AI service are tools to assist legal professionals and should not be considered as a substitute for careful review of the original transcript. Users should verify important information in the original deposition transcript.

Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by Depo-Sum.

Depo-Sum has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Depo-Sum shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

Disclaimers

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Depo-Sum its subsidiaries, affiliates, and its licensors do not warrant that:

  • The Service will function uninterrupted or be available at any particular time or location
  • Any errors or defects will be corrected
  • The Service will be free of viruses or other harmful components
  • The results of using the Service will meet your requirements
  • The transcript summaries generated will be completely accurate

Limitation of Liability

In no event shall Depo-Sum, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

We shall not be liable for any loss, damage or expense arising from your use of our Service or from your reliance on the transcript summaries generated by our AI service. You acknowledge that legal work requires professional judgment and that our Service is provided as a tool only.

In no event shall the total liability of Depo-Sum, whether in contract, tort (including negligence) or otherwise, exceed the amount paid by you to Depo-Sum for the Service that gave rise to the claim.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of [State], United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. Termination
